2. Artificial Intelligence and Third-Party Processing

Some of our Apps utilize Artificial Intelligence (AI) to function.

• Operational Sharing: To process your requests, your Input Data is shared with third-party AI service providers (such as OpenAI, Google, or Anthropic).
• AI Training Disclosure: Please be aware that Input Data you provide may be used by these third-party AI providers to train, improve, or refine their machine learning models. TechRay Apps LLC does not control the data once it is transmitted to these providers. We strongly advise that you do not share sensitive personal information, proprietary data, or confidential details within your AI prompts.
• No Selling of Data: We never sell your personal information or Input Data to third-party data brokers or marketing firms.

3. How We Use Your Information

We use the collected data strictly for the following purposes:

• Core Functionality: To relay your inputs to AI models and provide the generated output.
• App Maintenance: To troubleshoot bugs, monitor stability, and optimize the user experience.
• Customer Support: To respond to your questions or technical issues sent to our support email.

4. Data Retention and Deletion

• Retention: We retain account data for as long as your account is active. While we do not store AI Input Data on our servers longer than necessary to complete your request, third-party AI providers may retain logs according to their own data retention policies.
• Account Deletion: You can delete your account and associated data directly within the App settings.
• Manual Requests: You may request a complete data wipe by emailing [email protected]. We will process these requests within 30 days.

5. Security

We implement industry-standard security measures, including HTTPS/TLS encryption, to protect your data during transit from your device to our service providers.

6. Children's Privacy

Our Apps are not directed at children under the age of 13. If you believe a child has provided us with personal data without parental consent, please contact us immediately so we can delete the information.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Apps will be uninterrupted, secure, or error-free. Your use of the Apps is at your sole risk. We do not warrant that the results of using the Apps will meet your requirements or that any defects in the Apps will be corrected.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHRAY APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Apps
• Any conduct or content of any third party on the Apps
• Any content obtained from the Apps
• Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory

IN NO EVENT SHALL TECHRAY APPS LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, OR LOSSES ARISING OUT OF OR RELATING TO THE APPS OR THESE TERMS EXCEED $100.00. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Dispute Resolution and Class Action Waiver

Any dispute arising out of or relating to these terms or the Apps shall be resolved through binding arbitration on an individual basis, except that you and TechRay Apps LLC may assert claims in small claims court if your claims qualify.

CLASS ACTION WAIVER:YOU AND TECHRAY APPS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND TECHRAY APPS LLC AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

We may update this Privacy Policy from time to time. The updated policy will be posted on this page with a revised "Last Updated" date. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.

11. Governing Law

These terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.
